White Glove Carrier Network Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the White Glove Carrier Network website (whiteglovecn.com), our online courses, and related services (together, the “Services”).

These Terms are entered into between you and White Glove Carrier Network (“WGCN,” “we,” “us,” or “our”). By buying a course, creating an account, taking a course, or otherwise using the Services, you agree to these Terms and confirm that you have read our Privacy Policy.

If you do not agree to these Terms, do not use the Services.

1. Eligibility

You must be at least 18 years old and able to enter into a binding contract to use the Services. If you use the Services on behalf of a business, you confirm that you are authorized to accept these Terms for that business, and “you” includes that business.

2. What WGCN Does, and What It Does Not Do

WGCN provides online training resources for white glove delivery specialists who handle the last mile delivery of big and bulky items. The courses cover in-home delivery, placement, and customer service.

WGCN does not:

Hire, dispatch, schedule, route, supervise, or pay drivers, helpers, or carrier businesses.
Find or guarantee delivery work, contracts, or income.
Act as a motor carrier, freight broker, freight forwarder, shipper, 3PL, staffing agency, or employer.
Provide background checks, drug tests, insurance, licensing, or verification of anyone’s insurance, licenses, or legal status.
Cover freight, middle mile, artwork, medical equipment, or other specialty work that requires special licensing or insurance.

3. Courses and Pricing

WGCN offers two courses. You can buy one course or both courses as a bundle. Each purchase is a one-time payment for one person. One course costs $49.99, and both courses cost $64.99. Each purchase gives 3 months of access. Prices are shown on our Pricing page and at checkout.

The price and course details shown at checkout apply to your purchase.

4. Course Access

Each purchase gives one person access to the course or courses bought. You can use a course for 3 months from the date you buy it. We send course access to the email address used at checkout.

Each course is made of short lessons on its topic. Course 1 includes quizzes.

WGCN courses are private, independent training. Taking a WGCN course is not a government license or permit; it is not an assessment of your skills in the field; and it is not a guarantee of your work, honesty, safety, or legal standing. WGCN does not check, approve, or vouch for anyone who takes a course. You may not say or imply that a WGCN course is issued or endorsed by any government agency, association, retailer, carrier, or other third party.

WGCN may update course content. We will not remove a course you bought during your access period without reasonable notice.

5. Not a Consumer Reporting Agency

WGCN is not a consumer reporting agency, and the Services do not provide “consumer reports” under the Fair Credit Reporting Act or similar laws. Do not use the Services for background checks or to decide anyone’s eligibility for employment, credit, insurance, or housing.

6. No Employment, Agency, or Partnership

Using the Services does not create an employment, agency, partnership, joint venture, franchise, broker-carrier, contractor, or subcontractor relationship between WGCN and any user, business, carrier, driver, helper, 3PL, retailer, or other party. Nothing in the Services makes WGCN responsible for any delivery, installation, or service you perform or receive.

7. Your Account

Give accurate, current, and complete information, and keep it up to date. Keep your password confidential, and tell us right away at support@WhiteGloveCN.com if you think someone else has used your account. You are responsible for activity under your account. Use one account per person. Do not share accounts or sign up on someone else’s behalf without their permission.

8. Your Content

“Your Content” means anything you submit to the Services, such as messages and quiz answers. You keep ownership of Your Content. You give WGCN a non-exclusive, worldwide, royalty-free license to host, store, copy, and use Your Content to operate and improve the Services. This license ends when you delete the content or your account, except for copies kept in backups or as required by law.

You confirm that you have the rights to Your Content and that it does not violate anyone’s rights or the law. Do not upload anyone else’s photo or logo without permission.

Testimonials. If you give WGCN a testimonial, WGCN may publish it with your name and business name only if you agree to that. We will publish testimonials only as you gave them, and we will disclose any payment, discount, or other benefit you received for them.

9. Payments

Price and payment. Prices are in U.S. dollars and do not include taxes unless stated. You authorize WGCN and its payment processor, Stripe, to charge your payment method one time for the course or bundle you choose and any applicable taxes.

No automatic renewal. Course purchases are one-time payments. We do not charge you again unless you buy another course.

All sales are final. No refunds once course access starts.

Price changes. We may change course prices. A price change does not affect a purchase you already made.

Coupons and promotional pricing. A coupon or discount applies only as stated in the offer.

11. Course Content and Intellectual Property

WGCN course content, videos, quizzes, articles, wiki pages, software, logos, names, and designs are owned by WGCN or its licensors and are protected by intellectual property laws. WGCN gives you a limited, personal, non-transferable, revocable license to use them only for your own training and authorized use of the Services. You may not copy, download (except where we provide a download), record, share, publish, resell, modify, reverse engineer, scrape, or create derivative works from them without our written permission. “White Glove Carrier Network” and “WGCN” are WGCN’s trademarks.

Educational content only. Course and wiki content is general training. It is not legal, safety, insurance, or professional advice, and it does not replace manufacturer instructions, your customer’s requirements, workplace safety laws (such as OSHA rules), or local codes. Do not attempt any lift, installation, electrical, gas, water, or other work that you are not qualified, licensed, or insured to do.

12. Acceptable Use

You agree not to:

Break any law or regulation, or infringe anyone’s rights.
Upload malware or harmful code, or try to break, probe, or overload the Services.
Access accounts or data that are not yours, or try to get around payments or access controls.
Automate your course or quizzes, or have someone else take them for you.
Harvest, scrape, or misuse personal information.
Harass, threaten, or harm anyone.
Misrepresent your identity or your affiliation with WGCN or anyone else, or say or imply that WGCN has approved or vouched for you.
Use the Services for fraud or to mislead anyone.

13. Suspension and Termination

You can stop using the Services and ask us to delete your account at any time (see our Privacy Policy). Deleting your account ends your course access.

We may suspend, restrict, or end your access if you break these Terms, fail to pay, misuse the Services, create risk for WGCN or others, or act fraudulently or unlawfully. Where reasonable, we will tell you why and give you a chance to respond.

Sections that by their nature should survive termination, including Sections 5, 6, 8, 10, 11, and 14 through 21, survive.

14. Disclaimers

The Services are provided “as is” and “as available.” To the fullest extent permitted by law, WGCN disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and availability.

WGCN does not guarantee that:

You will get any work, contract, or business because you took a WGCN course.
Any carrier, retailer, or customer will accept or rely on WGCN training.
The Services will satisfy any legal, regulatory, insurance, carrier, shipper, broker, 3PL, or retailer requirement.
Use of the Services will prevent damage, injury, claims, accidents, or disputes.
Anyone who took a WGCN course will perform work well, safely, lawfully, or at all.

WGCN is not responsible for the work, conduct, or omissions of any user, including any delivery, placement, installation, or other work, or any damage, injury, or loss caused by a person who took a WGCN course. You are responsible for deciding whether the Services meet your needs and for following the laws, contracts, and insurance requirements that apply to your work.

15. Limitation of Liability

To the fullest extent permitted by law, WGCN and its affiliates, officers, directors, employees, agents, contractors, and service providers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, business opportunities, data, or goodwill, or business interruption, arising out of or related to the Services or these Terms, even if advised of the possibility of those damages.

To the fullest extent permitted by law, WGCN’s total liability for all claims arising out of or related to the Services or these Terms will not exceed the greater of (a) the amount you paid WGCN for the Service giving rise to the claim during the 12 months before the event giving rise to liability, or (b) $100.

Some jurisdictions do not allow some of these limits, so they may not apply to you. Nothing in these Terms limits liability that cannot be limited by law.

16. Indemnification

You agree to defend, indemnify, and hold harmless WGCN and its affiliates, officers, directors, employees, agents, contractors, and service providers from and against any claims, liabilities, damages, losses, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to:

Your use or misuse of the Services, or Your Content.
Your violation of these Terms, any law, or anyone’s rights.
Your misrepresentation of your affiliation with WGCN, or any claim that WGCN approved or vouched for you.
Your business operations, delivery or installation work, carrier operations, worker classification, or relationships with any driver, helper, carrier, 3PL, retailer, customer, or other party.

17. Privacy

Our Privacy Policy explains how we collect, use, and share information. It is part of these Terms.

Our Privacy Policy also explains how we use cookies and your cookie choices. You can change your cookie choices anytime with the Cookie settings link at the bottom of every page.

18. Electronic Communications

You agree that we may send notices, receipts, and other communications to the email address on your account, and that these electronic communications satisfy any legal requirement that they be in writing. Keep your email address current.

19. Governing Law and Disputes

Informal resolution first. Before filing a claim, you and WGCN agree to try to resolve the dispute informally. Send a written description of the dispute to support@WhiteGloveCN.com (we will contact you at your account email), and both sides will negotiate in good faith for 30 days.

Governing law. These Terms are governed by the laws of the State of Nevada, without regard to conflict-of-law principles.

Courts. Any dispute that is not resolved informally will be decided exclusively in the state or federal courts located in Clark County, Nevada, and you and WGCN consent to the jurisdiction of those courts, except where prohibited by applicable law. Either party may instead bring a qualifying claim in small claims court.

20. Copyright (DMCA) Policy

WGCN respects intellectual property rights and expects users to do the same. If you believe content on the Services infringes your copyright, send a notice to our copyright agent:

Your notice must include:

Your physical or electronic signature.
Identification of the copyrighted work you claim has been infringed.
Identification of the material you claim is infringing, with enough information for us to locate it.
Your name, mailing address, telephone number, and email address.
A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law.
A statement that the information in the notice is accurate and, under penalty of perjury, that you are the copyright owner or authorized to act on the owner’s behalf.

Counter-notice. If your content was removed and you believe it was removed by mistake, you may send a counter-notice to the same email address with: your physical or electronic signature; identification of the removed material and where it appeared; a statement under penalty of perjury that you have a good-faith belief it was removed by mistake or misidentification; your name, address, and telephone number; and a statement that you consent to the jurisdiction of the federal district court for your address (or, if you are outside the United States, any judicial district where WGCN may be found) and will accept service from the person who sent the original notice. We may restore the material in 10 to 14 business days unless the person who sent the original notice tells us they have filed a court action.

Repeat infringers. In appropriate circumstances, we will end the accounts of users who repeatedly infringe copyrights.

21. General Terms

Changes to the Services. We may change, suspend, or discontinue parts of the Services. If we stop offering a course during your access period, we will tell you and offer a replacement course.
Changes to these Terms. We may update these Terms. When we do, we will change the “Last updated” date. For material changes, we will notify you by email or on our website before they take effect. If you keep using the Services after that, you accept the updated Terms. If you do not agree, stop using the Services. Changes do not apply to disputes that arose before the change.
Entire agreement. These Terms, the Privacy Policy, and any plan details shown at checkout or in a separate written agreement are the entire agreement between you and WGCN about the Services.
Severability. If any part of these Terms is unenforceable, the rest stays in effect.
No waiver. Our failure to enforce a term is not a waiver of it.
Assignment. You may not transfer these Terms without our written consent. We may transfer them in a merger, acquisition, or sale of assets.
Force majeure. We are not liable for delays or failures caused by events beyond our reasonable control.
Accessibility. We want the Services to be usable by everyone. If you have trouble accessing any part of them, contact support@WhiteGloveCN.com and we will help.
California users. Under California Civil Code Section 1789.3, California users may contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs in writing at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by telephone at (916) 445-1254 or (800) 952-5210.
